National News: A shocking case has come to light from Kondatti area of Kerala, where a woman was divorced by her husband on the phone. According to the report, the victim had been living separately from her husband for the last one year and was living in her maternal home. The woman alleges that her husband and in -laws committed a long cruelty and mental harassment with her, causing her separation from her husband. At present, the police is seriously investigating all aspects, considering the matter sensitive. Officials want to ensure that the victim gets justice and appropriate action should be taken on the basis of the truth of the allegations.
The victim told the police in her complaint that her husband called her father's mobile number directly and called her 'divorce' and announced to end the relationship. The call was allegedly considered to be the official form of divorce and the woman lodged a complaint with the police, calling it a serious matter.
On the basis of the complaint, the police have registered a case against the husband under Section 498A (matrimonial cruelty), 406 (criminal betrayal), 34 (shared criminal intention) against the husband. Also, provisions have been added under the Muslim Women (Protection of Marriage Rights) Act 2019, which considers triple talaq as a punishable offense.
According to an official of the Women's Cell, the phone has been confiscated by which the husband called a divorce. The call of the call is with the police and further action will be taken after its confirmation. The officer also clarified that if necessary after investigation, the sections included in the FIR can also be changed.
The police is currently investigating the matter deeply and final legal steps will be taken only after confirmation of all the facts. This case is another example in cases registered under the triple talaq law, how the effect of this practice still exists in the society.
