Supreme Court Rejects Rape Convict Asaram's Interim Bail Plea On Health Grounds

The Supreme Court declined to grant interim bail to rape convict Asaram on medical grounds on Thursday, but permitted him to engage a trained caretaker of his choice for round-the-clock assistance.

New Delhi: Asaram Bapu, who is serving a life sentence for raping a minor girl in Jodhpur, has not received any relief from the Supreme Court. The Top Court has currently refused to grant interim bail on the grounds of his ill health. The court, while keeping Asaram's petition pending, stated that he may seek interim bail again if his condition worsens. 

What was stated by the court?

A bench comprising of Justices MM Sundresh and PB Varale stated that Asaram does not need to be hospitalized, but he will require continuous medical care.

What was the statement of the government?

According to Solicitor General Tushar Mehta, who was representing the government of Rajasthan, Asaram had hidden the fact that he was on interim bail while requesting 20 days' parole from the High Court. Presently, Asaram has been granted 20 days' parole from the High Court. In the last hearing regarding the interim bail application, the Supreme Court has asked for a detailed medical report from AIIMS to pass an order regarding Asaram Bapu's bail application.

What does the report say?

The court wanted to know how serious Asaram's health condition truly was and whether he should be granted interim relief on medical grounds. According to the report by AIIMS, Asaram didn’t require hospitalization but his health status was required to be monitored round the clock.

The Supreme Court has given the liberty to Asaram of having a trained caretaker of his choice round the clock. Top Court has also given the liberty to Asaram of approaching the court in case of any deterioration of his health. When Solicitor General Tushar Mehta pointed out that Asaram had concealed information about the ongoing case from the High Court and obtained parole, the bench condemned this action. On Wednesday, the Rajasthan High Court granted Asaram 20 days parole, considering his long prison sentence and his behavior during interim bail
