Prayagraj: The Allahabad High Court has granted permission to a 16-year-old rape victim to terminate her pregnancy and stated that the woman has the right to make decisions regarding her body and reproduction. The court clarified that this right is an integral part of the rights to life, personal liberty, and privacy guaranteed under Article 21 of the Indian Constitution.
During the hearing, Special Public Prosecutor Savita Pathak presented the victim's medical report, which stated that the woman was carrying twins for approximately seven weeks.
According to the March 19 ultrasound which was happened at the Women's Hospital in Prayagraj, revealed both fetuses were alive.
Additional District and Sessions Judge Anju Kanaujia, who was hearing the case, stated that women's bodily autonomy and reproductive decisions should be respected.
In the order, the court stated that women's reproductive rights cannot be unnecessarily restricted in cases involving minors and unwanted pregnancies, as doing so would undermine their constitutional rights.
The court also noted that the victim's family had informed the investigating officer of the pregnancy on May 9, but despite this, no timely steps were taken to initiate an abortion.
The court justified the abortion, considering the circumstances of the case and the victim's condition. In its decision, the court stated that a woman's dignity, bodily autonomy, and reproductive rights are protected by the Constitution. It also directed the relevant medical authorities to take necessary action in accordance with the provisions of the law.
