Gujarat: Asaram’s lawyers told the Gujarat High Court that he is 86 years old and suffering from heart-related illness. They argued that his medical situation requires continuous treatment outside the prison environment. The lawyers also mentioned that the Jodhpur Court had earlier granted him six months of relief in a similar plea. They stated that denying him medical treatment would be against basic human rights.
They presented medical papers and doctor reports to support their claims. The defense stressed that this bail is not permanent and will last only for six months. They also added that if the legal hearings do not progress further, they may request extension later.
The Gujarat High Court considered the medical documents submitted by the defense before making its decision. The court noted that the Jodhpur Court had already examined similar medical claims and granted relief earlier. Therefore, the Gujarat High Court stated that it cannot take a completely opposite view unless the circumstances change. The court also mentioned that temporary bail does not cancel the original sentence. It is only meant for treatment during a specific period. The court clarified that the bail is only for six months and will be reviewed later. If new evidence or objections arise, the order may be reconsidered.
The survivor’s lawyer strongly opposed the bail by questioning the medical grounds submitted. They claimed that Asaram has been seen traveling freely between cities like Ahmedabad, Indore, and Rishikesh in the past. They argued that if his condition was truly serious, he would have been admitted to a hospital long-term. The lawyer pointed out that most of his recent treatments have been general wellness therapies, not critical medical interventions. They said that these facts raise doubt about whether health is the real reason behind the bail request. They insisted that the decision should be made carefully to avoid misuse of legal relief.
The state government said that if medical facilities in Jodhpur Jail are not adequate, Asaram can be shifted to Sabarmati Jail, where better treatment is available. They added that the government will ensure proper medical supervision during the bail period. The government also stated that they have no objection if the court orders strict monitoring of his movement. However, they emphasized that the law must be followed equally for all, regardless of identity or status. They also clarified that if the Rajasthan government challenges the Jodhpur bail order, Gujarat may also respond accordingly in future hearings.
After the order, the legal paperwork will be completed before his release. Once the documents are processed, Asaram can leave prison for six months. However, he must follow the conditions set by the court. These conditions may include staying at a fixed address, informing authorities before travel, and attending medical check-ups as required. If any condition is broken, the bail may be canceled. After six months, the court will review medical reports again before deciding on further extension or cancellation. This ensures the bail is not misused.
If the appeal hearing related to Asaram’s life sentence does not move forward in the next six months, his legal team may request more time. The court will again check medical reports to decide the next step. If health improves, the bail may not be extended. If health worsens, the court may consider continuation. The final decision will depend on medical evidence, not personal claims or public reaction. This means the case will continue to go through legal scrutiny step by step.
