SC Allows Manufacturing of Green Crackers in Delhi-NCR, But Sale Remains Banned

SC also directed the Centre to work with stakeholders and present a solution on the ban on sale and storage of firecrackers in Delhi-NCR by October 8.

National News: The Supreme Court has allowed green firecrackers to be made in Delhi-NCR, but did not allow their sale in the region. The top court gave permission to certified manufacturers who have approvals from NEERI and PESO to produce green crackers, with the strict rule that they will not sell them in the National Capital Region. The matter will be reviewed again on October 8.

Permission for Manufacturing Only

The court, led by Chief Justice of India BR Gavai and Justices K Vinod Chandran and NV Anjaria, said manufacturers with proper certification can continue making green firecrackers. However, they must give an undertaking that none of these crackers will be sold in the prohibited areas of Delhi-NCR until further orders.

Revising the Complete Ban

The Supreme Court asked the Centre to review the total ban on firecracker production in Delhi-NCR after consulting all parties involved. The bench observed that a full ban may not be practical. It pointed out that despite a complete ban, enforcement has often failed. The court gave an example of Bihar, where a total mining ban led to illegal mining. A balanced solution is needed, the judges said.

Opinions from Both Sides

During the hearing, senior advocate Aparajita Singh argued for a total ban on firecrackers, saying allowing manufacturing could lead to their use in banned areas. On the other hand, manufacturers requested permission to produce under strict rules, including public declaration of quantities. The CJI said, “If they follow the rules, why not allow manufacturing? Extreme orders create problems. Let them produce, but no sale in NCR until further notice.” The case is part of the ongoing discussion on air pollution in Delhi-NCR, including concerns over firecrackers and stubble burning.
