New Delhi: The Supreme Court has given an important decision regarding the promotion of government employees. The court has clearly said that no government employee has the legal right to ask for promotion. Employees can only expect that their names will be considered as per the rules, but they cannot claim promotion.
This decision came in a case related to Odisha Transport Department. The matter was regarding appointment and promotion to the post of Assistant Regional Transport Officer (ARTO). Some employees said that they should get promotion under the old rules, but the government had changed the selection process. After this controversy the matter reached the Supreme Court.
During the hearing, the court said that the government has the right to change the service rules as per the need. If the new policy is within the ambit of law and there is no arbitrariness in it, then employees cannot demand promotion on the basis of old rules. The court also said that it is not necessary to fill every government post by promotion. If the government wants, it can also adopt a selection process or other system.
The court also made it clear in its decision that employees have the right to be considered only in a fair manner. That is, if an employee is eligible, his name should be considered as per the rules, but getting promotion cannot be considered certain.
