New Delhi: During the hearing in the Supreme Court of India, the Delhi government made it clear that the law controlling fees of private schools will not be implemented in this academic session. The court had asked the Directorate of Education whether it was practical to implement it in the middle of the session. After this the government decided to postpone it for now.
This matter is related to Delhi School Education (Transparency in Fixation and Regulation of Fees) Act, 2025. The purpose of this law was to stop arbitrary fee increases in private schools and to bring transparency to the process of determining fees. But schools argued that it would be difficult to implement it mid-session.
The Additional Solicitor General, appearing for the Delhi government, citing the Gazette notification dated February 1, said that schools will not be able to charge more fees for the 2025-26 session than what is being charged from April 1, 2025. If any school charges higher fees, then it will be controlled under the law. However, cases related to the validity of the law are still pending in the High Court and the Supreme Court.
Private schools have heaved a sigh of relief with this decision. He said that sudden implementation of new rules would have caused administrative and financial problems. Many schools described this as a “practical pause,” not a return to law. They believe that this will provide enough time to understand and implement the rules.
Parents' organizations are partially satisfied with the decision, but their concerns still remain. He says that in the last two years many schools have increased fees arbitrarily. They are demanding that financial audit of schools should be done and the fee structure should be made public, so that transparency is maintained.
The Supreme Court bench said its main concern was that the law was being implemented “in a hurry.” The court made it clear that at present there is no need for any additional order after the clarification from the government.
Delhi government says that the law has not been abolished, but it will be implemented after removing the procedural hurdles. This means that in the coming time, fee regulation committees will be formed and school fees will be monitored.
Schools have got relief for now, but parents' hopes still rest on fee transparency and accountability.
