In a setback for Google and Microsoft, the Delhi High Court has directed the tech giants the identify and removal non-consensual intimate content from the URLs. Which, the tech giants said that they lack the technology to identify such content.The tech giants while challenging the review order passed by a Single Judge bench of the high court argued, “AI [Artificial Intelligence] has not yet reached the level to figure out consent.”In October 2023, the Delhi High Court directed Google and Microsoft to review a previous order related to the removal of intimate photographs and videos shared without consent. This decision was made to ensure that these tech giants were complying with the courts directives effectively.The issue arose from a case where a womans intimate photos were shared without her consent on various platforms, leading to her filing a complaint with the court. The court initially ordered Google, Microsoft, and other social media platforms to remove the content and take steps to prevent its dissemination. However, the court later discovered that despite the order, some content was still accessible online.Therefore, to address this lapse and to ensure the implementation of its directives, the Delhi High Court asked Google and Microsoft to file a review of their actions concerning the removal of such sensitive material. This demonstrates the courts commitment to protecting individuals privacy and dignity in the digital space.
