Lessors to get back GoAir aircrafts! Delhi HC directs DGCA to de-register 54 planes

Due to financial issues, GoAir has grounded its entire fleet of aircraft since May 2023 and companies who leased the airplanes wanted to take back the possession.

The Delhi High Court ordered the DGCA to de-register 54 aircraft leased to GoAir because the airline was facing financial troubles and had been grounded since May 2023. The lessors, who are the owners of the airplanes that GoAir was leasing, wanted to get their aircraft back. The court has directed that the process shall be done not more than five working days.

The resolution professional (RP) designated by the insolvency law to oversee the airline and its directors was also prohibited by Justice Tara Vitasta Ganju from removing or transporting the aircraft, spare parts, paperwork, records, and other materials.

The high court directed the DGCA and the Airports Authority of India to assist the petitioner lessors and grant them access to the airports. Now the lesser are allowed to export the aircraft as per the applicable rules and laws.

  • Due to the financial situation, GoAir has grounded its entire fleet of aircraft since May 2023.
  • The companies that leased the airplanes to GoAir (lessors) wanted to take back possession of their aircraft.

The DGCA, the aviation regulatory body in India, had previously declined to process the lessors' de-registration applications. However, the Delhi High Court ruled in favor of the lessors and directed the DGCA to process the de-registration applications for all 54 aircraft within five working days.

Some of the lessors who approached the high court are: Accipiter Investments Aircraft 2 Limited, EOS Aviation 12 (Ireland) Limited, Pembroke Aircraft Leasing 11 Limited, SMBC Aviation Capital Limited, SFV Aircraft Holdings IRE 9 DAC Ltd, ACG Aircraft Leasing Ireland Ltd and DAE SY 22 13 Ireland Designated Activity Company.
