Delhi Court Rejects Umar Khalid’s Interim Bail Plea to Care for Ailing Mother (x)

New Delhi: The Delhi Court on Tuesday has refused to grant interim bail to Umar Khalid, who is in judicial custody in the Delhi riots conspiracy case. He sought interim bail for 15 days to take part in the post-death rituals of his maternal uncle and to care for his ailing mother.

What is there in the plea?

The petition stated that Umar Khalid's maternal uncle, Khurshid Ahmed Khan, passed away on April 10, 2026, and his Chehlum, the 40-day post-death ritual,  is scheduled for May 24. Furthermore, his mother has been ill for a long time and is scheduled to undergo surgery on June 2.

What did the court say?

In the Karkardooma Court in Delhi, additional session judge Sameer Bajpai was hearing Umar Khalid’s plea.  

Umar Khalid told the court that his father is 71 years old and is unable to care for his mother. He has five sisters, four of whom are married and live separately. As the eldest son, he is responsible for caring for his mother.

What happen in Delhi court?

The defense also argued that Umar Khalid had been granted interim bail several times before and had never violated any conditions. Co-accused had also been granted relief for family reasons.

However, the special public prosecutor opposed the petition, arguing that the accused was taking advantage of the court's leniency. The prosecution argued that the maternal uncle's death was not a reason to grant interim bail. Furthermore, the mother's surgery was routine and other family members could care for her.

In its order, the court stated that every interim bail application is evaluated on its facts and that relief can only be granted in appropriate and urgent circumstances. The court acknowledged that attending the uncle's Chehlum was not "so essential." The court also noted that if the relationship were so close, the accused would have sought relief at the funeral itself.

Regarding his mother's surgery, the court noted that Umar Khalid's sisters and father are there to care for her. The court also acknowledged that the surgery was minor in nature and did not require the accused's presence.
